40 Years of Zen Store — Terms of Service

1. Who we are and what these terms cover

The Store is operated by 40 Years, Inc., a corporation doing business as 40 Years of Zen, of 1710 Keller Pkwy, #6090, Keller, TX 76248, United States. These terms apply to your access to and use of the Store and to every order you place through it.

Our Shop Refund Policy and Shop Privacy Policy form part of these terms. Where these terms conflict with the Refund Policy on returns, refunds or membership billing, the Refund Policy controls.

These terms cover buying from our online store at https://shop.40yearsofzen.com (the "Store"), operated by 40 Years, Inc. d/b/a 40 Years of Zen. Placing an order means you accept them.

They do not cover our main website at 40yearsofzen.com (and any successor domain), or booking, paying for or attending a 40 Years of Zen program. Those are governed by the Main Website Terms and Conditions, the Main Website Privacy Policy and the Billing, Cancellation and Rescheduling Policy published there.

2. Who can order

You must be 18 or older and able to enter into a contract. Orders are for personal use. Please email us before ordering for resale or wholesale. We ship within the United States unless the Store states otherwise at checkout.

3. Products, prices and orders

We describe products as accurately as we can, and colors and packaging can differ from the photographs. Prices are in US dollars and can change without notice, though never on an order we have already accepted. Applicable sales tax is calculated and shown at checkout.

Your order is an offer to buy. We accept it when we send you a shipping confirmation, not when you receive an order acknowledgment. Stock is finite, and occasionally an item sells out between your order and our packing it — we will contact you and refund that item.

Errors happen. Where a price or a product detail is plainly wrong, we may cancel the order and refund you in full rather than fulfill it. We may also refuse or cancel any order, including where we cannot verify the payment or the address, or where the quantity looks like resale.

4. Shipping, delivery, title and risk

Delivery estimates shown at checkout are estimates, not guarantees, and we are not responsible for carrier delays. Title and risk of loss pass to you when the carrier delivers the order to the address you gave us. You are responsible for entering a correct and complete shipping address; a package returned to us because of an incorrect address may be reshipped at your cost. If a package is confirmed delivered but you cannot find it, contact us and we will help you open a claim with the carrier.

5. Supplements and wellness products — please read

Statements about the supplements sold here have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure or prevent any disease.

Nothing sold in this Store is medical advice, medical treatment or a diagnosis, and nothing here is part of the clinical care provided in the 40 Years of Zen program. If you are pregnant or nursing, taking medication, or managing a health condition, talk to your physician before using a supplement or a neurotechnology device. The Satoria System and Neuronic LIGHT are consumer wellness devices, not medical devices, and are not intended to diagnose or treat any condition.

Do not use a neurotechnology device if you have a seizure disorder or photosensitive epilepsy, an implanted electronic medical device, or any other contraindication identified in the product's own instructions, without first consulting your physician. Stop use and seek advice if you experience an adverse reaction. Keep supplements out of reach of children.

California Proposition 65. Some products sold here may carry a Proposition 65 warning. Where one applies, it is shown on the product page or the product label.

6. Using the device and the app

Use hardware as its own instructions direct. Device and app terms from their manufacturer or publisher apply alongside these terms, and where the two conflict on the operation of the device or the app, theirs governs that. Software and app access is licensed to you, not sold, for personal non-commercial use, and you may not copy, modify, reverse engineer or redistribute it.

7. Satoria membership and automatic renewal

The Satoria membership is what keeps your Satoria System working: it covers access to the Satoria app, its guided programs, and support. Buying a Satoria System requires a membership, and you choose which one at the point of purchase.

By selecting a membership at checkout you are enrolling in an automatically renewing subscription. Monthly — $17.99, charged every month. Yearly — $179.99, charged every year. Your membership renews automatically at that price, on that cycle, and we will charge the payment method you used at checkout each time it renews, until you cancel. The first payment is taken when you place the order; each renewal falls on the anniversary of that date. You may cancel at any time in the Satoria app, or by emailing info@40yearsofzen.com from the address on your order. There is no cancellation fee, no notice period and no minimum term.

 

We will send you an acknowledgment of your membership terms after purchase, and we will notify you by email before any change to the price or the plan takes effect, in time for you to cancel first. Cancelling stops the next renewal; the period you have already paid for runs to its end and part-used periods are not refunded. Full membership billing, cancellation and failed-payment terms are set out under Membership billing and cancellation in our Refund Policy, which forms part of these terms.

Cancelling a membership does not affect your ownership of hardware you have bought. It ends the app access and support the membership covers.

8. Returns and refunds

Returns, replacements, faulty items and refunds are governed by our Shop Refund Policy. In summary: coffee and supplements are not returnable but are replaced or refunded if they arrive damaged, wrong or not at all; devices and accessories may be returned within 30 days of delivery if unused and in original packaging, after emailing us first.

9. Accounts and acceptable use

If you create an account, you are responsible for keeping your credentials secure and for activity under your account. Tell us promptly if you suspect unauthorized use. You agree not to use the Store unlawfully, to interfere with its operation or security, to scrape or data-mine it, to place fraudulent orders, or to submit false information.

10. Intellectual property

All content on the Store (text, graphics, images, product photography, page design, and the 40 Years of Zen and Satoria names, logos and marks) belongs to 40 Years, Inc. or its licensors and is protected by intellectual property law. You may not copy, reproduce or use it commercially without our written permission. Product names and marks of other manufacturers belong to them.

11. Reviews and submissions

If we offer product reviews or you send us testimonials, photographs, suggestions or other material, you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, publish and display it in connection with our business, and you confirm you have the right to grant that license. Do not submit anything unlawful, misleading, infringing or that makes disease-treatment claims. We may remove any submission at our discretion.

12. Electronic communications

By placing an order or providing your details you consent to receive communications from us electronically, including order, shipping and membership notices by email, and you agree these satisfy any requirement that a communication be in writing. Marketing emails include an unsubscribe link. If you opt in to text messages, message frequency varies, message and data rates may apply, carriers are not liable for delayed or undelivered messages, and you can reply STOP to opt out or HELP for help. Consent to marketing is not a condition of purchase.

13. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE STORE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE STORE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS. Products may carry a manufacturer's warranty; where they do, that warranty is between you and the manufacturer, and we will help you use it.

14. Liability

To the fullest extent the law allows, we are not liable for indirect, incidental or consequential loss arising from products bought here, and our liability for any order is limited to what you paid for it. Nothing in these terms limits any right you have that cannot be limited by law, or excludes liability for fraud or for death or personal injury caused by our negligence where such exclusion is prohibited.

15. Indemnity

You agree to indemnify and hold harmless 40 Years, Inc., its affiliates and their officers, directors, employees and agents from any claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of a product, or your unlawful use of the Store.

16. Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Disputes arising from an order placed here are resolved by binding individual arbitration, on the same terms as the Dispute Resolution and Arbitration provision of the 40 Years of Zen Main Website Terms and Conditions, which is incorporated into these terms by reference and available at https://40yoz.framer.website. In summary, and read together with that provision:

•      You must first give us notice of a dispute at Legal@TheAspreyGroup.com and 45 days to resolve it.

•      Arbitration is before a single arbitrator under AAA or JAMS rules, and may be commenced in Austin, Texas or the federal judicial district that includes your billing address.

•      You and we waive the right to a jury trial and to participate in a class, collective or representative proceeding.

•      Either party may still bring a qualifying individual claim in small claims court, or seek injunctive relief in court to protect intellectual property.

•      You may opt out of arbitration within 30 days of your first order by emailing Legal@TheAspreyGroup.com with the subject line "Arbitration Opt-Out."

 

Please read the full provision before ordering. Subject to arbitration, the exclusive venue for any court action is Travis County, Texas.

17. Privacy

Our Shop Privacy Policy explains what we collect when you browse and order, and the choices you have. This Store handles orders and payments only; it is not where any health information about you is held or asked for. Information you give us in connection with a 40 Years of Zen program is handled under the Main Website Privacy Policy instead.

18. General

•      Severability. If a provision is unenforceable, the rest remains in effect.

•      No waiver. Not enforcing a provision does not waive it.

•      Assignment. You may not assign these terms without our consent; we may assign them in connection with a merger or sale of assets.

•      Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control.

•      Entire agreement. These terms, with the Refund Policy and Privacy Policy, are the entire agreement about your purchases from the Store.

19. Changes and contact

We may update these terms; the version in force is the one published here when you order.
