40 Years, Inc., a Delaware corporation d/b/a 40 Years of Zen ("40 Years of Zen Store," "we," "us," "our") operates the Store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). The Store is powered by Shopify, which enables us to provide the Services to you.

This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Shop Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

This Privacy Policy applies to our online store at https://shop.40yearsofzen.com (the "Store"), operated by 40 Years, Inc. d/b/a 40 Years of Zen and powered by Shopify.

It does not apply to our main website at 40yearsofzen.com (and any successor domain), or to information you give us in connection with a 40 Years of Zen program, including intake, health and neurophysiological data. That information is covered by the separate Main Website Privacy Policy.

1. Personal information we collect or process

When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information collected anonymously or that has been de-identified so that it cannot identify or be reasonably linked to you. We may collect or process the following categories, including inferences drawn from them, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

•      Contact details including your name, address, billing address, shipping address, phone number, and email address.

•      Financial information including credit card, debit card and financial account numbers, payment card information, transaction details, form of payment, payment confirmation and other payment details. Card details are collected and processed by our payment processors; we do not store full card numbers.

•      Account information including your username, password, security questions, preferences and settings.

•      Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel, and your past transactions.

•      Membership information including your Satoria plan, renewal dates and billing history.

•      Communications with us including the information you include in communications with us, for example when sending a customer support inquiry or a product review.

•      Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.

•      Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.

We do not ask for or collect health information through the Store. Please do not send us medical details through the Store; if you need to discuss a health question relating to a program, use the contact route on our main website.

2. Where we get personal information

•      Directly from you when you create an account, visit or use the Services, place an order, communicate with us, or otherwise provide us with your personal information;

•      Automatically through the Services from your device when you use our products or services or visit our websites, and through cookies and similar technologies;

•      From our service providers, including Shopify, when we engage them to enable certain technology or when they collect or process personal information on our behalf;

•      From our partners or other third parties, including advertising, analytics and shipping partners.

3. How we use your personal information

•      Provide, tailor and improve the Services. To perform our contract with you, process payments, fulfill orders, remember your preferences and items you are interested in, send notifications related to your account or order, process purchases, returns, exchanges and other transactions, create and manage your account, manage your membership and its renewals, arrange shipping, facilitate returns and exchanges, enable you to post reviews, and create a customized shopping experience such as recommending related products.

•      Marketing and advertising. To send marketing and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously purchased or added to your cart and other activity on the Services.

•      Security and fraud prevention. To authenticate your account, provide a secure payment and shopping experience, and detect, investigate or act on possible fraudulent, illegal, unsafe or malicious activity. If you register an account, you are responsible for keeping your credentials safe; we strongly recommend you do not share your username, password or other access details with anyone.

•      Communicating with you. To provide customer support, to be responsive to you, to provide effective services, and to maintain our business relationship with you.

•      Legal reasons. To comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies; to investigate or participate in civil discovery, potential or actual litigation or other adversarial legal proceedings; and to enforce or investigate potential violations of our terms or policies.

4. How we disclose personal information

In certain circumstances we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

•      With Shopify, vendors and other third parties who perform services on our behalf, such as IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping.

•      With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have the right to direct us not to share information about you for targeted advertising — see Section 8.

•      When you direct, request or consent to disclosure to third parties, such as to ship you products or through your use of social media widgets or login integrations.

•      With our affiliates or otherwise within our corporate group.

•      In connection with a business transaction such as a merger, acquisition or bankruptcy; to comply with applicable legal obligations, including responding to subpoenas, search warrants and similar requests; to enforce any applicable terms of service or policies; and to protect or defend the Services, our rights, and the rights of our users or others.

5. Our relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside.

To help protect, grow and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about those interactions. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over the use of your personal information for these purposes.

6. Cookies and tracking technologies

We and our service providers use cookies, pixels, tags and similar technologies on the Store to keep it working (for example, remembering your cart and keeping you signed in), to measure performance, and to support advertising. Most browsers allow you to refuse or delete cookies through their settings; if you do, parts of the Store may not work properly. Where required, we present a cookie banner or preference tool that lets you accept or reject non-essential cookies.

Opt-out preference signals. The Store recognizes the Global Privacy Control (GPC) signal. Where we receive GPC from your browser, we treat it as a request to opt out of the sale or sharing of personal information for that browser and device. We do not otherwise respond to "Do Not Track" signals, which have no agreed standard.

7. Sale and sharing of personal information

We do not sell your personal information for money. However, our use of advertising and analytics cookies to show you personalized advertising may be considered a "sale" or a "share" for cross-context behavioral advertising or targeted advertising under laws including the California Consumer Privacy Act and the Texas Data Privacy and Security Act.

You may opt out at any time using the "Your Privacy Choices" / "Do Not Sell or Share My Personal Information" link in the Store footer, by broadcasting a Global Privacy Control signal, or by emailing us using the details in Section 15. We do not sell or share sensitive personal information or biometric data, and we do not knowingly sell or share the personal information of anyone under 16.

8. Your rights and choices

Depending on where you live, you may have some or all of the rights below. These rights are not absolute, may apply only in certain circumstances, and in certain cases we may decline your request as permitted by law.

•      Right to access / know. To request access to personal information we hold about you.

•      Right to delete. To request that we delete personal information we maintain about you.

•      Right to correct. To request that we correct inaccurate personal information.

•      Right of portability. To receive a copy of your personal information and, in certain circumstances and with certain exceptions, to have it transferred to a third party.

•      Right to opt out of sale or sharing for targeted advertising. As described in Section 7.

•      Right to limit use of sensitive personal information, where applicable.

•      Managing communication preferences. We may send you promotional emails; you may opt out at any time using the unsubscribe option in our emails. If you opt out, we may still send non-promotional messages about your account, orders or membership. If you opt in to text messages, reply STOP to opt out and HELP for help; message and data rates may apply and message frequency varies. We do not sell, rent or share mobile numbers or SMS opt-in and consent data with third parties for their marketing purposes.

You may exercise these rights where indicated on the Services or by contacting us using the details in Section 15. We will not discriminate against you for exercising them. We may need to verify your identity before processing a request, as permitted or required by law. You may designate an authorized agent to make requests on your behalf; before accepting a request from an agent we will require proof you have authorized them, and we may need you to verify your identity directly with us. We will respond within the time required by applicable law.

9. Complaints and appeals

If you have a complaint about how we process your personal information, please contact us using the details in Section 15. If we decline a rights request, you may appeal by emailing us with the subject line "Privacy Appeal." We will respond within the period required by applicable law and explain our reasoning. Depending on where you live, you may also lodge a complaint with your state Attorney General or your local data protection authority.

10. Notice to California residents

The categories of personal information we collect, the sources, purposes and recipients are described in Sections 1 through 4. We collect identifiers, customer records, commercial information, internet and network activity, approximate geolocation derived from IP address, and inferences. We disclose each of those categories to service providers and, for advertising purposes, to advertising partners. We do not collect sensitive personal information through the Store beyond account credentials, and we do not sell or share sensitive personal information. To opt out of sale or sharing, see Section 7.

11. Notice to Texas and other state residents

If you are a resident of Texas, Virginia, Colorado, Connecticut, Utah, Oregon, Montana or another state with a comprehensive privacy law, you may exercise the rights in Section 8 to the extent that law provides them, and appeal as described in Section 9. We may sell or share personal information — but not sensitive or biometric personal information — for targeted advertising as described in Section 7. You may opt out at any time.

12. Third-party websites and links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness or reliability of information found on them. Information you provide on public or semi-public venues, including third-party social networking platforms, may be viewable by others without limitation as to its use by us or by a third party. Our inclusion of a link does not by itself imply endorsement.

13. Children's data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the details below to request that it be deleted. As of the last updated date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) the personal information of individuals under 16 years of age.

14. Security, retention and international transfers

No security measures are perfect or impenetrable, and we cannot guarantee "perfect security." Any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on factors such as whether we need it to maintain your account or membership, to provide you with the Services, to comply with legal obligations such as tax and accounting requirements, or to resolve disputes and enforce our contracts and policies. Order and payment records are generally retained for the period required by law; marketing contact details are retained until you unsubscribe and for a reasonable period afterwards to honor your opt-out.

We may transfer, store and process your personal information outside the country you live in. If we transfer personal information out of the European Economic Area or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses or an equivalent contract issued by the relevant competent UK authority, unless the transfer is to a country determined to provide an adequate level of protection.
